User Agreement, Guidelines, Terms of Use and Rules of Engagement:

User Agreement, Along with Freedom of Speech comes great responsibility.

By accessing this site, you agree to these terms and the terms of our Privacy Policy. You may terminate this agreement with The Alexandria Library Project, at any time, by going to your platform, “My Platform>My Account” and deleting your account.

This User Agreement governs your relationship with The Alexandria Project. By your access and use of this site, you agree and are bound by the terms of this User Agreement, and our Privacy Policy.

This site is understood to provide a free speech platform restricted only by the Constitution of the United States and under the “Rule of Law” provided therein.  It is further understood to comply with the spirit of section 230, regarding uncensored freedom of speech. The Alexandria project bears no legal responsibility for the users, (subscribers) and therefore does not censor speech on our platform except to the extent required by the rule of law.  If you post it you own it and are responsible for it. We do not necessarily agree or subscribe to your opinion and therefore are not responsible for it. Opinions and content expressed on this site is the sole responsibility of the person who originated the content, and the Alexandria Project is not responsible for any such content.

We prefer not to remove community members or member-provided content. We prefer to leave decisions, about what is seen and who is heard, to each individual. We shall not determine what content will removed on the basis of the opinion expressed or within the content or context at issue.  If you submit content from other sources, or other protected content, you affirm that, in addition to complying with our “Terms, Guidelines and Policy”’ that you are also complying with the sources potentially more restrictive “Terms, Guidelines and Policy”. Users are encouraged to use our native video capabilities whenever they wish to avoid the more restrictive terms and guidelines.

We endeavor to allow all free speech that is lawful and does not infringe the legal rights of others. We support the US Constitution and law enforcement. We will remove content when the law requires us to exclude content from our platform, i.e., we will support the “Rule of Law”. We will not knowingly allow our site to be used as a tool for crime, or other unlawful acts. We may remove member content that constitutes or evidences such activity. We may remove any content and terminate access to our services or cease to provide services at any time, if adjudicated that such content violates the law, this User Agreement, or our Policy or are otherwise engaging in unlawful conduct. We shall have no liability to users for removing any content, or for terminating your access to our services.

You agree to receive communications from the Alexandria Project, including communications sent by phone, email, text message, or other means of communication.

You may not use this site unless you affirm the following applies to you.  You are; either an adult over the age of 18 years; an emancipated minor at least 13 years old; or you have express permission from your parent or legal guardian to use this site; You are legally allowed to use in the domicile you reside. You may not use the site or accept the terms on behalf of any other entity, such as a company or organization, unless you have legal authority to bind that entity to these terms; or you have not been previously banned from using the Site.

Content  Prohibited by Law; Users will not knowingly include any of the following on this Website or in the user or customer’s directory on Company’s web servers: (i) Pornography, text, graphics, sound, or animations that might be viewed as obscene or illegal; (ii) links to other websites pornography, that might be viewed as obscene or related in any way to illegal activities; or (iii) destructive elements or destructive programming of any type, all as determined by this Company, in its sole discretion.

Users will not knowingly include any information or knowledge that is protected by Law, trade secret, deemed not to be shared in public domain, or posted for public consumption, or considered a secret for National Security purposes, or otherwise considered illegal under the Laws of the United States.  All published information is the sole responsibility of the person or entity who posts or publishes herein. 

Copyright infringement is strictly prohibited.  We reserve the right to, terminate the account of any repeat infringer. If your copyright has been infringed by any content and you did not grant permission for this use, you may submit a notice that meets the requirements of the Digital Millennium Copyright Act (DMCA), 17 U.S.C 512(c)(3). Submit notice to our Web master or admin at admin@Alexandriaproject.net. Your notice must include: (1) electronic or physical signature of the copyrighted work owner (or person authorized by the copyright owner), (2) a description of the copyrighted work, including the URL where the infringing content is available, or a copy of it, (3) contact details of the person submitting the notice, including email address, telephone, and mailing address, (4) statement in “good faith belief” that the work is not authorized by the copyright owner, and (5) a statement by the sender that all of the above information is accurate, and that the person sending the notice is either the copyright owner or is authorized to act on behalf of the copyright owner. We will take whatever action, in our sole discretion, is considered appropriate, including removal of the challenged content. The Alexandria Project will have no liability to you for removing any content, or for terminating access to our site terminating an account. You agree to receive communications, including communications sent by phone, e-mail, text message, or other means of communication.

Posting spam and using bots is strictly prohibited. Spam or Spamming is strictly prohibited on our sites. When visitors leave comments on the site we check for spam, collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help with spam detection. Any spam detected and the User Registration, posts and comments are summarily deleted.  All other Registration and Login data is maintained in our spam and firewall software record for blocking and blacklisting purposes.  You must agree so don’t Spam us.

You agree to provide the Alexandria Project, our service providers or partners, license to display advertising in connection with your content and otherwise monetize your content without compensation to you. You warrant that you have all rights necessary to grant these rights to the Alexandria Project and our users, (subscribers).  You also agree to grant license to any personal content posted by you to our site,  including worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, share and distribute your content.

You also agree to grant the Alexandria Project a limited non-exclusive, royalty-free license to any user, (subscriber) to use (share), copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute any content posted by you, solely in connection with that users use of the Alexandria Project. The licenses granted by you hereunder do not include any moral rights or right of attribution. This User Agreement, Guidelines, and terms of use may be amended or appended as may become necessary. You may at any time, opt out by deleting your “My Account” and content thereby terminating the agreement.

Use of the Alexandria Project are provided to you “as is”’ and at your own risk. There are no express or implied warranties, SUCH AS MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. The Alexandria Project “Disclaims” all warranties and conditions except those that cannot be disclaimed under the law. The Alexandria Project makes no representations regarding the form or function of the site or any content available through the Site and “Disclaims” responsibility or liability to you arising from your use or from content provided by you or any other person, even if such content is untrue, harmful, damaging, offensive, inappropriate, fraudulent, tortious, unlawful, contrary to social norms, politics, etc. Regardless of efforts or lack thereof, to review or monitor content, you agree that you will not rely on this fact for any purpose.

The Alexandria Project has no responsibility or liability to user (subscribers) arising from loss of data from a hacking event, data breach, theft, misuse of information, conspiracy, racket, fraud, act of terrorism, misappropriation of information, technical malfunction, interruption of service, or similar event that may cause you to suffer damage, loss, or injury, including without limitation any damage to or loss of your personal property, data, operations, information, reputation, goodwill, profits, etc. To the maximum extent permitted by applicable law, and regard-less of the nature of the cause of action, We are not responsible if information made available on this site which is not accurate, complete or current. The material on this site is provided as information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or original sources of information. Any reliance on the material on this site is at your own risk.

The Alexandria Project will not be liable to user (subscribers), for any direct, indirect, incidental, consequential, special, or punitive damages, or for any lost profits, whether incurred directly or indirectly, or for intangible losses, arising from (a) user access to or use of (or inability to access or use)of the services; (b) from the acts or omissions of any other person or third party, including, without limitation, any defamatory, offensive, or illegal conduct of other persons or third parties; (c) any content obtained from services; (d) business revenue or personal income loss; (e) unauthorized access, use, or alteration of your content or communications through the services. In no event shall the aggregate liability arising out of or relating to these terms or the services exceed the greater of two hundred U.S. dollars (U.S. $200.00) or the amount you paid to use  the Alexandria Project, if any, in the past six months for the services giving rise to the claim. The limitations of this section shall apply to any theory of liability, whether based on warranty, contract, statute, tort (including negligence), or otherwise, and shall further apply whether or not the Alexandria Project has been informed of the possibility of any such damages and even if a remedy laid out in these terms is found to have failed its essential purpose.

User (subscribers) agree to hold harmless the Alexandria Library Project and any employees, associates or subsidiaries for any event resulting from the use of this site. You agree to indemnify, defend and hold harmless our organization, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Warranty. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties. Please review carefully the third-party’s policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

Applicable Law and Jurisdiction. The laws of the State of Idaho, excluding its choice of law provisions, will govern these Terms and any dispute that arises between Users and the Alexandria Project. All disputes related to these Terms or the Services will be brought solely in the state or federal courts located in Kootenai County, Idaho, United States, and you consent to personal jurisdiction and waive any objection as to inconvenient forum. Users (subscribers), affirm that you are competent to agree to be bound by this User Agreement, meaning that you are over the age of 18, an emancipated minor, or have legal parental or guardian consent. Parents of minors should be aware that, in addition to the NSFW filters made available by the Alexandria Project, there are a number of Parental Control products and features available on the market, which can help you tailor your child’s experience on our platform. The Alexandria Project cannot waive any right to enforce this User Agreement, unless it does so expressly in writing. No waiver of any part of this User Agreement will be a further or continuing waiver of that part or any other part, and no failure to enforce any part of his User Agreement will be deemed a waiver of any kind. The Alexandria Project may modify the Terms of this User Agreement from time to time in any way without notice to users, and you agree to be responsible for making yourself aware of any modification of the Terms and to be bound by any modification of the Terms when you continue to access or use the Site after any such modification. As a matter of courtesy, we will endeavor to inform its users of any such changes. Each newer dated revision supersedes all prior agreements.

Except for the statements in this document and the documents expressly incorporated herein by reference, no statement by The Alexandria Project or anyone associated with the Project, whether verbal or written, can modify or supplement the Terms of this User Agreement unless the modification or supplement is stated expressly in writing by referring to this User Agreement. If any of the Terms in the User Agreement are held to be invalid or unenforceable by a court or arbitrator or by operation of law, the remaining Terms will remain in effect.
